An ELPL policy is generally written to provide protection for the personal assets of a corporate attorney against claims alleging legal malpractice.
Sarbanes-Oxley and Dodd-Frank have imposed heightened duties, and exposures, on the corporate attorney. While a D&O policy may provide some protection for the attorney, especially if the attorney is a director or officer, this coverage varies and is not absolute. Purchasing an ELPL policy eliminates the potential gap in coverage in a D&O Policy, and covers a corporate attorney in their own right.
