If the home is still mortgaged, one can refer to the title insurance policy to determine whether or not coverage is provided for: A-Encroachments by improvements on the insured property impacting the adjacent neighbor's land, and/or
B-Encroachments by a neighbor's improvements onto the first party's land.
If no cover ,the client can then ask his title insurance carrier to endorse these coverage's onto the policy, all of which, will be for an additional premium.:
The title company may not wish to do this,or,may only wish to provide cover under either
A or B above.
Another alternative is the American Land Title Association Policy, which generally covers both situations (A & B) mentioned above
This policy however, is on the pricy side.
